This contest is administered by Beejive, Inc. ("Beejive").

How to Enter: To enter, submit a photo or video of you using BeejiveIM to contest@beejive.com, along with the following information: full name, date of birth, email address, and contact phone number. Entries must be received by 11:59PM Pacific Standard Time on February 10, 2010. You can only enter this contest by email. Entries that are incomplete or corrupted will be disqualified. You may send as many entries as you like, as long as each entry is in a separate email and contains all of the information stated above. Proof of submission will not be deemed to be proof of receipt. All entries become the property of Beejive, and will not be acknowledged or returned. In the event of a dispute over the identity of an entrant, the entry will be deemed submitted by the authorized owner of the email account used for submission at the time of entry.

Conditions: This contest is open to entrants who are at least 18 years of age at the time of entry. This contest shall be governed only according to United States law. By participating in the contest, (i) you agree to be bound by these official rules, including all eligibility requirements, (ii) you agree to be bound by the decisions of Beejive, which are final and binding in all matters relating to the contest, (iii) you agree that your contest entry is not misappropriated, depicts you personally, and does not and will not infringe any third party's copyright, patent, trademark, or trade secret, or violate any third party's right of privacy, or entail libel or defamation, and (iv) you agree that you have personally submitted your entry. Beejive employees and family members are not eligible to win. Failure to comply with these rules may result in disqualification from the contest. This contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited by law.

Prizes: Beejive will select four total winners: one grand prize winner and three runners up. The grand prize winner will win a 64GB Apple iPad (WiFi-only model), and runners up will each receive a 32GB iPod Touch. Beejive will endeavor to ship runner-up prizes to winners by March 1, 2010, and the iPad grand prize when the product is generally available from Apple. Beejive cannot guarantee any shipping or delivery dates due to factors beyond its control, including but not limited to delayed product release dates, low product availability from the manufacturer, and freight company delays. Winners will be notified by email when their prizes have shipped, and these emails will contain freight tracking numbers if available.

Odds: Odds of winning depend upon the number of eligible entries received.

Judging: Eligible entries will be judged by Beejive employees, and winners will be chosen at their sole discretion. The decisions of the judges will be final and binding on all matters related to the contest. Winners will be announced on www.beejive.com on February 12, 2010, and will be notified using the email addresses used for submission. If Beejive does not receive an email acknowledgement of receipt of a winner notification email by 11:59PM Pacific Standard Time on February 17, another winner will be chosen to replace the non-responding entrant.

Privacy Notice: By entering this contest, any information that you submit will be disclosed to Beejive and the contest judges. All submitted information becomes the property of Beejive and may be used as Beejive sees fit, including but not limited to future marketing campaigns, web sites, and other widely available materials.

General Release: Beejive reserves the right to disqualify any entrant or entry for any reason. BEEJIVE SHALL HAVE NO LIABILITY WHATSOEVER RELATING TO CONTEST SUBMISSIONS, INCLUDING BUT NOT LIMITED TO SUBMISSIONS THAT VIOLATE A THIRD PARTY'S PRIVACY OR INFRINGE A THIRD PARTY'S TRADEMARK. IT IS THE SOLE RESPONSIBILITY OF THE SUBMITTER TO ENSURE THAT SUCH VIOLATIONS DO NOT OCCUR.

Disclaimer of Liability: Beejive shall not be responsible for (i) any typographical or other error in the publishing of the contest rules, prizes, announcements, or otherwise, (ii) lost, late, corrupted, or incomplete entries, (iii) the failure of any third party to comply with the instructions and proper administration of this contest. You agree that Beejive shall not be liable for any injury, damage, or loss of any kind claimed to be caused in any way by participation in this contest. In the event that Beejive is prevented from continuing with the contest by any event beyond its control, Beejive shall have the right to modify, suspend, extend, or terminate the contest.

Law: This contest shall be governed by and interpreted under the laws of the State of California, without regard to any conflict such laws may have with any other jurisdiction. Any and all disputes or claims arising in connection with this contest shall be resolved individually, and any action or litigation concerning the contest shall take place exclusively in federal or state courts in the State of California. By entering, you expressly consent to the jurisdiction of these courts and you waive all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. YOU HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY'S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.
